General terms governing the use of our website and services.
These Service Terms and Conditions (in addition to Customer's "Agreement") are agreed to by and between Konceptio Data Services, LLC ("Company") and the customer ("USER") as designated on their Service Order.
Konceptio Data Services, LLC shall provide USER with an account on the Company's network, which will allow USER to access the Internet. USER's Account will include access to the World Wide Web, electronic mail ("e-mail"), and other Services commonly associated with the Internet.
Credit Check: SUBSCRIBER authorizes Konceptio Data Services, LLC to perform a credit check prior to providing any equipment or Services.
Due Date: If Subscriber's payment is not received by the end of the workday on the tenth of the month, it will be considered past due. A $15.00 late fee will be charged.
Method: All equipment, installation, and non-revolving services are to be prepaid. Recurring charges are billed monthly. Where an approved automatic payment method is used, Konceptio Data Services, LLC shall automatically debit payments.
Reconnection: Any account that is disabled must pay a reconnect fee equal to one month of service in addition to any past due fees.
Hardware/Data: Konceptio Data Services, LLC nor its subcontractors will be liable for any loss of data or damage to hardware that occurs during installation of or any service performed on your computer. USER agrees that it is their responsibility to completely backup their computer before installation.
Unauthorized Access: Neither Konceptio Data Services, LLC nor its network Services supplier will be liable for unauthorized access to or alteration, theft, or destruction of end user's data files, programs, or information through accident, fraudulent means, or devices.
Warranties: These Services are provided on an "as is" and "as available" basis without warranties of any kind either expressed or implied. Neither Konceptio Data Services, LLC nor its affiliates warrant that these Services will be uninterrupted or error-free.
USER understands that neither Konceptio Data Services, LLC nor its network Services supplier is responsible for the content of the transmissions that may pass through the Internet. USER agrees not to use the Services in ways that violate laws, infringe the rights of others, or interfere with the users, Services, or equipment of the network (e.g., "spamming", propagating viruses, etc.).
If Konceptio Data Services, LLC causes an error, delay, defect, breakdown, or failure in service, defined as lasting for more than 4 hours during any calendar month, an out-of-service credit will be calculated based on a 9% daily prorated credit (1/60) of any monthly service charge. The maximum credit allowed shall not exceed the Monthly Charge for the service interrupted.
Upon expiration, cancellation, or termination of the Agreement, USER shall relinquish any IP addresses or address blocks assigned to USER by Konceptio Data Services, LLC. Customer may not use any forced means to reset, reverse engineer, modify, or change hardware, software settings, or radio location.
