Terms of service for residential and business customers.
This Service Terms and Conditions Agreement is agreed to by and between Konceptio Data Services, LLC ("Company") and the Customer ("SUBSCRIBER") as designated on the Service Order.
Authorization: SUBSCRIBER warrants that they are at least 18 years of age and own the premises or have received permission from the owner to make changes needed to install equipment (e.g., drilling holes, running wiring).
Access: SUBSCRIBER agrees to allow Konceptio Data Services, LLC or its contractors access to the premises to perform installation, repair, or maintenance activities.
Liability: Konceptio Data Services, LLC will not be liable for any alterations or damage to the premises that result from installation or removal of equipment, including holes in walls, cable wiring, or antenna mounting brackets.
Initial Term: This Agreement will have an initial term as designated on the Service Order. At the end of the term, this Agreement will automatically renew for successive one-month periods.
Termination: Services may be terminated by advising Konceptio Data Services, LLC in writing. Early termination fees may apply if a contract term is in effect.
Due Date: Payment is due upon receipt of invoice. If payment is not received by the end of the workday on the 10th of the month, it will be considered past due.
Fees: A late fee (up to $15.00) will be charged on past due accounts. To reactivate services after a suspension for non-payment, a reconnection fee of $50.00 will be required.
Prepayment: All equipment, installation, and non-revolving services are to be prepaid unless otherwise agreed.
Ownership: Any equipment provided by KDS Networks (Optical Network Terminals, Radios, Routers) remains the property of KDS Networks unless purchased directly by the subscriber.
Warranty: KDS provides a limited parts and labor warranty for the equipment and installation for 30 days from the date of installation. This warranty excludes damage resulting from abuse, negligence, or Acts of God.
Bandwidth: SUBSCRIBER agrees to comply with any bandwidth usage limitations associated with their specific plan. If usage consistently exceeds limits, KDS may require the subscriber to upgrade their plan.
IP Addresses: Any IP addresses assigned to you are controlled by Konceptio Data Services, LLC and are not transferable. We reserve the right to change IP assignments at any time.
Data Backup: SUBSCRIBER agrees that it is their responsibility to completely backup their computer/data prior to installation. KDS is not liable for any loss of data.
Service Interruptions: These Services are provided on an "as is" and "as available" basis. KDS does not warrant that services will be uninterrupted or error-free. In the event of a Konceptio-caused error lasting more than 4 hours, a prorated credit may be requested.
SUBSCRIBER agrees to indemnify and hold Konceptio Data Services, LLC harmless from any claims made by third parties arising out of the use of the equipment or services provided.
